The Workers’ Compensation Manager (WC) is responsible for all WC-related claims management, including proactive management of WC claims to accelerate claim closure, mitigate risks, and manage financial exposure.

The ideal candidate has experience adjusting workers’ compensation lost time and medical only claims in an insurance company, third party administrator (TPA), or self-insured/high-deductible employer environment. This position ensures compliance with applicable WC state laws, NDCP policies and procedures related to on-the-job injuries and collaborates with the Company’s Leave Administrator to support compliance with WC, FMLA, and ADA integration.

Responsibilities

Principal Duties and Responsibilities

  • Serve as the primary liaison in managing the Company’s WC third-party administrator (TPA), ensuring quarterly performance / quality reviews are completed.
  • Liaison with NDCP’s Safety Managers, HR leadership, third-party broker representative and TPA claim adjusters in setting / maintaining appropriate claim reserves.
  • Establish and maintain appropriate medical care provider panels and directories in all states where NDCP operates, ensuring an appropriate level of care and service is maintained in all operational areas.
  • Manage all WC vendor management to include the selection and maintenance of outside vendors for agreed upon services and fees for specific claim management functions for greater cost control. Establish and maintain an NDCP approved vendors list for use by its TPA for claim management. This list is inclusive of defense attorneys and other ancillary service providers (e.g., diagnostics, durable medical equipment (DME), Field Case Management (FCM), Telephonic Case Management (TCM), Surveillance and other subrogation investigations, etc.). Ensure appropriate Certificates of Insurance are on file when that service is not already vetted by the insurance company or the TPA.
  • Responsible for WC litigation management, collaborating with the CHRO, CFO, NDCP Safety Managers, VP, Finance, insurance broker representative(s), TPA adjuster, and assigned legal counsel regarding WC-related claim litigation and settlements.
  • Ensure insurance coverage and associated billing in monopolistic states (currently OH only) is maintained and premiums are validated and bills paid in a timely manner.
  • Collaborate with the applicable Company manager(s) and HR business partners to drive increased adoption of NDCP Return-to-Work initiatives.
  • Create and deliver supervisory-level and above training on NDCP’s workers compensation program / processes and effective workers compensation management techniques.
  • Ensure all Company positions are accurately NAICS coded and manage NDCP’s annual WC premium audit.
  • Ensure the timely and accurate completion of DART reports and OSHA reporting.
  • Review all proposed terminations of employment of individuals on WC-related leave(s) with the applicable HR Director prior to any involuntary termination of employment.
  • Serve as the back-up / overflow to the WC Supervisor and/or WC Specialist(s), as needed, to ensure WC-related administration is timely and accurate.
  • Communicate, as needed, with injured employees, third-party claims representatives, medical clinics, etc. to ensure the timely delivery of medical treatment and the processing of claim payments.
  • Grant reserve concurrence/approval for total incurred amounts up to $250,000 or more.
  • Grant settlement authority of amounts up to $150,000 or more (lump sum payment).
  • Conduct claim settlement review meetings with the CHRO, CFO, and VP, Finance, as needed, but no less than quarterly to facilitate review and approval of proposed settlements and financial forecasting for total incurred amounts (paid + outstanding reserves) that exceed $250,000 for reserves and $150,000 for lump sum settlements.
  • Schedule monthly meetings with NDCP Operations leaders and applicable HR business partners to review current work / claim status of all open WC claims.
  • Work with the Safety Managers to identify accident and injury trends by location and communicate findings to operational leadership.
  • Oversee the daily activities of the Supervisor, Workers’ Compensation / Sr. Specialist and proactively mentor the incumbent(s) to broaden their knowledge of WC claim and risk management.

Qualifications

  • Bachelor’s degree is strongly preferred. High School Diploma is required.
  • Minimum of 10 years of hands-on management experience working in a WC role involving the management of a WC Supervisor, WC claim adjusters, and/or employer WC Specialist(s), within a multi-state, self-funded/high-deductible WC program at the corporate level.
  • Minimum of 2 years of experience working in a human resources-related workers compensation, benefits and/or generalist role at the corporate level strongly preferred but not required.
  • Proven experience with reserve authority of $250,000 and above and settlement authority of $150,000 and above.
  • Proven ability to generate statistical reports in Excel, Word, or other applications.
  • Demonstrated ability to communicate succinctly both verbally and in writing to provide claim status updates (customized to the designated audience).

 

Knowledge and Skills 

· Proficient in WC claim reserving philosophies and practices.

· Proficient in WC settlement evaluation and negotiation skills.

· Professional claim designation (e.g., AIS, CWCP, CLA, SCLA, CPCU, etc.) not required but a plus.

· Strong understanding / knowledge of WC-related regulations, as well as general knowledge of FMLA and ADA laws and the application to WC-related absences.

· Proficient in Microsoft Office software, particularly Word and Excel required, with technical aptitude to quickly pick up the functional use of claims and/or risk management systems (based on the assigned TPA), ADP, etc.

· Ability to create meaningful analytical reports related to workers compensation claims and trends and communicate critical information to HR and operations leaders in a timely and effective manner.

· Strong self-initiative and effectively works independently.

· Exceptional organizational and follow-up skills, along with the ability to effectively prioritize work to complete assignments by established deadlines.

· Professional interpersonal skills and the ability to manage sensitive and confidential situations / materials in a legally compliant and appropriate manner.

· Managerial presence and the ability to communicate professionally and effectively, both in writing and verbally, with all levels of employees / outside vendors.
